I mean, if it's in red and white and has Ovechkin's face and an eagle on it, it's pretty clear what it's of, right?

Well, I assume RMNB isn't getting sued for trademark infringement.

That's what I want to know. You're clearly profiting by referencing the team. And it seems even more egregious if you're putting players' faces on their without them getting any of the proceeds.

They prolly don't have trademark rights to Ovie's face.

So there's nothing preventing me putting anyone's face I like on a t-shirt and selling it? Serious question. That seems kind of ridiculous to me.

... Yes, correct. You just can't sell it as if you're the caps

It's complicated, but the short answer is there are a couple things stopping you. Here's a good rundown: http://smallbusiness.chron.com/can-use-celebrity-images-tshirts-40638.html

The short of it is it's risky, but significantly less risky if you have reason to believe the person in question won't object to it. It stops being risky if you bother to ask and obtain permission.

Whoever took the photo could sue you. Ovi could sue you. The team? No.
