#23 — Brown Goes Down

This is the twenty-third post of Deke Dangle RPF Anon, a community for all your ice hockey anon meme needs.

THE RULES

IME if it's an in-person hearing then that's specified everywhere, but I can't say for sure they never leave that part off.

It's almost definitely a phone hearing (usually is unless specified otherwise). Not just because the Caps play tomorrow, so they have to do it quickly, but DoPS seems to value 1 playoff game as 5 regular season games, and there's no way in hell they plan to suspend him for more than 5 playoff games.

I'm pretty sure even Satan himself wouldn't get more than 5 playoff games. Which probably says a lot about both DoPS and Raffi Torres.

I mean, there is a literal 2-to-1 ratio for normal games to playoff games, so I guess my question is if he got 5 games, would he get 2 or 3 playoff games or 5 playoff games? I assume the former. And a nonsense fine.

What? They don't dole out punishment and then currency convert it into a "playoff" punishment. 5 games is 5 games, in terms of the threshold for phone versus in-person hearing. But given how they value playoff games, there is no way they will suspend him long enough to require an in-person hearing. I would honestly be a little surprised to see him suspended 2 games, and extremely surprised if it were 3.

I think this particular hearing would be easy to arrange in person wrt logistics, but I agree with everyone else that's there's no way he gets more than 4 playoff games, particularly with not being a "repeat offender" as defined in their policies.

I scrolled back through https://twitter.com/NHLPlayerSafety and between now and the Torres hearing, Duncan Keith's recent suspension is the only one that specifies an in person hearing was offered. I don't remember whether any others have happened this season.

The repeat offender technically only applies to fines and not suspensions. That's not to say that's how it works in practice, though.

There was a suspension recently where they mentioned him being a repeat offender (that Keith one I think?) even though there was quite a long time between them.

I thought that repeat offender status didn't matter in deciding whether or not to give supplementary discipline, but once the decision is made to discipline, it DOES affect the length of the suspension given. (Which is why Raffi Torres got such a long one.)

Officially the one thing it HAS to affect is the fine that accompanies the suspension, because the forfeited salary is calculated differently based on whether the player is a Repeat Offender according to the CBA or not - divided by games in the season if a repeat offender, and days (game day or not) in the season if not.

Otherwise past disciplinary actions, whether formally Repeat Offender or not, can be one of the factors taken into consideration when deciding whether to suspend and for how long. If you listen to the videos it's pretty clear that they do take it into account, but not how they take it into account.

DA With fines they only take into account the previous 18 months, too. With length of suspension they can look at the player's entire history.
