She accused rape specifically, though. Isn't penetration with an object legally sexual assault? If it was fingers, it could still show up because of skin cells. Less likely if it was an object, but still possible.

Per her account she was awake and screaming/thrashing (this was one of the parts not corroborated by her friend).

The biggest problem with using DNA evidence as absolute proof is that DNA collection and analysis is prone to human error, just like every other kind of evidence gathering. She might have accused PIV rape but he wasn't actually using his penis. Someone else might have raped her with him in the room, or holding her down, or so on. The nurse could have fucked up the DNA collection. There are a lot of options that aren't just "oh well no DNA so no crime! bye", which is why trials happen.

The article that giidas person links uses incredibly lazy thinking and has a slant towards MRAs that I dislike, but one paragraph of it is useful for comparison. If someone comes into a police station with their face bashed up, unless they're a professional boxer, a crime probably happened. It's different with rape because people have consensual sex all the time.

Except: people also fight one another willingly all the time. People also falsify assaults for revenge. People drunkenly fall down and have no idea if they fell or were punched the next day. Etc.

Nearly all allegations of crimes have some level of ambiguity. The only reason to believe, knowing what we know, that Kane is entirely innocent, is wanting to believe he's innocent. The actual evidence is not "beyond reasonable doubt" at all.

Where are you getting these details of her account?

Sedita's interviews.

This next comment isn't directed to you, nonny, but to meme in general: I feel like no one should be allowed to comment until they've actually watched Sedita's interviews. So many people misunderstanding so many things...

And I feel like no one should be allowed to comment until they gain a working knowledge of the legal system that's not 99% based in CBS procedurals. And yet, here we are.

I see we've reached the point where asking that people be informed about super basic things, like what someone did or didn't say, is bad and wrong. lol ok.

(Anonymous) 2015-11-08 03:58 pm (UTC)(link)
That is an enormous twisting of my words. Well done.

(Anonymous) 2015-11-08 04:01 pm (UTC)(link)
Yeah, and in a criminal case, knowledge of the legal system is basic.

na

And I think no one should be allowed to ever comment about this again because I'm super fucking tired of it.

Please mods. Ban the subject again.

perhaps you could...not read the thread???? what a concept!!!

Is anyone saying anything new? No, people are just rehashing the same arguments over and over again and it's incredibly fucking tedious.

I read through so much Bruins wank. Your pet circular topics aren't as interesting as you think. Learn to scroll.

Kane talk isn't only in this thread though. The other day there was talk about making him the bad guy in fics and he was mentioned in the game day thread, which should be fine for those who want to discuss Blackhawks games.

I think the people who want him banned find this thread and the conversation in it most annoying though, that's why I said that.

This should be the last thread devoted to the case, though. There's no need to make a new one next post. If someone write a new reaction blog post or something there are other places for it.

DA

Why don't we let that sort itself out in 3500 comments or so? This place is very different from every place else online that I've seen discussing the topic, so I don't know that there are, in fact, "other places for it."

I meant other places as in other threads, like the journalism threads.

+1 As a flat memer who just woke up, agreed. Absolutely nothing productive is happening, the investigation is over, and honestly the subject of debate is whether any kind of concrete conclusion can be reached at all... which it obviously can't. Nobody has changed their mind on meme and I can't see any good that will come out of further circular arguments, and I'm sure we have at least a few survivors who'd rather not see the discussion anymore either.

Re: Patrick Kane will NOT be prosecuted

(Anonymous) 2015-11-08 04:04 pm (UTC)(link)
Maybe you could let any survivors speak for themselves, instead of bringing them up as a justification for the fact that you're annoyed because you can't scroll. People want to talk about this. You don't have to read it.

Re: Patrick Kane will NOT be prosecuted

(Anonymous) 2015-11-08 04:08 pm (UTC)(link)
I don't think people want to actually talk about it. They just want to double down on whichever position they already had because we have no more new information at all.

Re: Patrick Kane will NOT be prosecuted

(Anonymous) 2015-11-08 04:10 pm (UTC)(link)
Yeah but still, if the mods banned every discussion where "nothing new was being said" we won't have very much to talk about at all. There's plenty of conversations here that I manage to scroll past without demanding that the topic be banned.

Re: Patrick Kane will NOT be prosecuted

(Anonymous) 2015-11-08 04:20 pm (UTC)(link)
This is a pretty serious topic, not whether Tom Wilson sucks or the Beatles are any good. It's also broken out over and over and nothing productive happens. I'm hoping this is just the last gasp now the investigation is over, but I just feel like people tend to get really upset about it and other than venting it's not really serving any purpose here. And the fact is, it was banned once before, and I don't think anyone missed it.

If you use DW Blocker everything will just poof down into a little red/pink line that says something like "blocked because contains ____". It's really easy and helpful. Just blacklist/whitelist like tumblr savior and tada!

Re: Patrick Kane will NOT be prosecuted

(Anonymous) 2015-11-08 05:15 pm (UTC)(link)
Use Dreamwidth Blocker; it works amazingly. Put the words "Patrick Kane" on the blacklist and you will never see this again.

I use DW Blocker all over the place and have never had a problem.

No one should be allow to comment until they attend law school and pass the bar and spend 2 years volunteering with a rape crisis hotline. Sorry, I don't make the rules.
