IANAL either, but workers compensation is no-fault, so the ref should be able to claim it regardless of who's responsible and whether the injury was maliciously caused. The point is that the worker doesn't have to go through the hassle of having to prove who is to blame before receiving compensation for the injury. But the coverage provided by workers comp is somewhat limited, so the ref would have to sue in order to get full wage replacement and any kind of payment for pain and suffering.

I think the issue with wage replacement is that Henderson was really close to retiring as a ref, so there might not be all that much wage to be replaced. I saw in the r/hockey thread that the 10 mil he's asking for is compensation for loss of future income from his post-NHL reffing career, and workers comp presumably wouldn't cover that.

The Puck Daddy article cites a tweet implying the Alberta government pushed for the suit: AB govt wants Wideman and Flames to cover cost of Henderson’s dental surgery, optometric, mental health, chiropractic, podiatrist services.

To me, that doesn't necessarily imply that the AB govt pushed for it (although they might well have, knowing that there's someone to sue to recoup their costs). If Henderson decided to sue on his own and won, he'd be obligated to use that money to first reimburse anything he got from workers comp, so the government always had a stake in it.
