I think a conviction is the only thing that's going to keep Kane off the ice for *somebody* (most likely the Hawks, for all the reasons listed) next season.

I desperately want a jury to shock the hell out of him and give him the max sentence (I think it's 25 years in NY), but this is not SVU so at this point I'm agreeing with the nonnie who asked "can I at least see the little rat bastard arrested in handcuffs?" because I would not be surprised if the case ends up dismissed before he's even arrested.

Pretty sure it's a judge who does sentencing? Juries just declare guilty or not guilty. But yeah, I agree with you. I want him to get convicted, but given the world we live in I'm just hoping he gets arrested.

Oops on my part, because wiki tells me that you are entirely correct about the judge doing the actual sentencing.

Does anybody know if rape in NY is a mandatory minimum prison time crime the way a lot of drug offenses are? Because otherwise (as I understand it, anyway) even a jury conviction could result in probation/a suspended sentence/little to no actual time behind bars at the judge's discretion.

(US nonnie, but 99% of what I know about the legal system at felony level is from Law & Order/assorted true crime shows/helpful nonnies.)

in NY there are about 25 different types of charges for sex crimes, 20 of which are felonies and 5 misdemeanors. there are no minimum sentences for misdemeanor convictions. for felony sex crimes, the minimum sentence depends on the felony class conviction and ranges from 2 years (class E) to 10 years (Class A).

Actually in theory you can get probation or conditional discharge for a felony here.

(When it comes to sex crimes in practice, this is often done when the offender is 16 or 17 because NY charged everyone as an adult at 16. The kid is sentenced to "probation" and then remanded to family court as a young person "in need of supervision" and then in effect sentenced to a residential treatment program. I used to work with those programs, which is why I know this.)

interesting. did you ever hear of this being used for an adult? NY's sentencing precedents are so arcane that I don't think we can really take any sentencing statutes as more than "guidelines".
